At Mardey’s, we take pride in offering high-quality appliances at unbeatable prices. As a unique retailer, unlike large chain stores, we specialize in providing aggressive pricing at wholesale price points, ensuring the best savings opportunities for our customers. Please review the following terms and conditions carefully before completing your purchase.
 

Sale Disclaimer
 
Please note that all sales of open-box appliances are final. While we understand that cosmetic damages, imperfections, blemishes, dings, and dents may be present on the product, these are not grounds for refunds, cancellations, or exchanges. By completing your purchase, you acknowledge and accept that these cosmetic imperfections do not affect the appliance’s functionality, and any concerns regarding appearance will not be eligible for a return or exchange.All products are covered by a full parts and labor warranty for 12 months from the date of purchase. We remain committed to addressing any functional issues within that period. In the event of any issues Mardey’s must be notified within 30 days of the purchase. Any issues outside of the 30 day window will be handled by the appliacable warranty company. 
 

Condition of Products
 
  • Our inventory includes both items in excellent condition and those with cosmetic imperfections (scratches, dents, dings, etc.).
  • Whether the product is open-box or factory-sealed, all products are sold AS-IS. This means that any imperfections or damages are not grounds for any form of compensation or adjustment.
  • We make every effort to describe each product’s condition in detail, but the risk associated with purchasing an item in its current condition is the buyer’s responsibility.
  • Appliances are graded based on cosmetic imperfections that are visible only when installed. Imperfections not visible once installed are not considered flaws.
  • All units, regardless of grade or imperfections, are guaranteed to function as intended and are backed by our warranty terms.
  • In the event of any issues Mardey’s must be notified within 30 days of the purchase. Any issues outside of the 30 day window will be handled by the appliacable warranty company. 
 

Important Considerations:
 
Our team works diligently to identify all visible front-facing imperfections on each product. However, minor scratches, blemishes, or imperfections may be unintentionally missed during the grading process. This inherent risk allows us to offer our customers the best prices. We encourage you to review product photos and descriptions carefully before purchasing to ensure you choose the appliance grade that best fits your needs.
 

Price Advantage
 
  • Unlike big-box retailers, we offer aggressive pricing at wholesale price points, passing on the best savings opportunities directly to our customers.
  • Because we sell open-box items, we can offer significant discounts compared to new, factory-sealed products.
  • Both open-box and factory-sealed products may have been returned, opened for display, or handled in a manner that results in minor imperfections. These lower prices reflect the condition of the products, including any imperfections such as scratches, dents, or other cosmetic issues.
 

Open-Box and Factory-Sealed Products
 
  • Even products still in their original packaging (factory-sealed) may be considered “open-box” if they have been returned or displayed.
  • Less than 5% of all factory-sealed products may come with any form of imperfection. While these products are typically in new, unused condition, imperfections may occur due to handling or external factors.
  • Both open-box and factory-sealed products fall under the same policy and may show signs of handling, but are sold at a significant discount to reflect their condition.
 

Packaging and Shipping
 
  • We take great care to package all appliances using appropriate protective materials to ensure safe delivery.
  • If a product arrives damaged, a claim must be filed directly with the freight carrier that handled the shipment.
  • We are not responsible for any damages that occur after the product has left our facilities. Any damage during shipping or delivery must be handled through the freight carrier.
 

Warranty and Service
 
  • All products come with a one-year standard warranty, covering parts and labor provided through our third-party affiliate.
  • Open-box appliances may not include original accessories, manuals, trims, or other components; customers should verify included items prior to purchase.
  • Qualified open-box appliances come with a standard 1-year parts and labor warranty, managed through Mardey’s partnered third-party warranty providers. The choice of warranty provider is determined by Mardey’s based on location and cannot be chosen by the customer.
  • Customers are responsible for registering the product with the warranty provider and understanding the terms of their warranty. Mardey’s is not responsible for managing, coordinating, or explaining warranty terms for customers.
  • Issues must be reported within 24 hours of delivery. Reports made after this period will fall under the “as-is” policy, and refunds or exchanges will not be available.
  • In the event of any issues Mardey’s must be notified within 30 days of the purchase. Any issues outside of the 30 day window will be handled by the appliacable warranty company. 
 

Buyer Acknowledgment
 
  • By making a purchase, you acknowledge that you understand the condition of the open-box appliance and accept the risks associated with any imperfections that may not be fully visible at the time of purchase.
  • You agree that you have read and understood our product descriptions, including any disclaimers about imperfections, and have reviewed all relevant photos.
  • All sales at Mardey’s are final, and products are sold “as-is.” Returns are not accepted. However, in rare cases, a return may be approved at the discretion of management and will incur a restocking fee based on the product and associated costs.
 

Limitation of Liability
 
  • Mardey’s will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use any product.
  • Customers acknowledge that Mardey’s is not responsible for any damage, loss, or injury, including property damage or personal injury, resulting from the use of the appliance.
 

Dispute Resolution
 
  • All disputes under these terms are governed by Florida law and must be resolved exclusively through binding arbitration conducted by the American Arbitration Association under its Consumer-Related Dispute Supplementary Procedures.
  • Arbitration is mandatory and final, precluding court actions. Arbitration costs are governed by the AAA’s rules.

Governing Law
 
These terms and conditions are governed by the laws of the State of Florida, without regard to conflict of law principles.

Terms Modification
 
Mardey’s reserves the right to modify these terms and conditions at any time without prior notice to the customer.

Severability
 
If any clause of these terms is deemed invalid or unenforceable, the remaining terms will continue in full force and effect.

Entire Agreement
 
These terms constitute the complete agreement between the customer and Mardey’s, superseding any prior agreements or communications.

Waiver
 
No waiver by Mardey’s of any term or condition shall be interpreted as a continuing waiver of that term or any other term..

Customer Responsibility Upon Delivery 
 
At Mardey’s, we take great care to ensure that every order is meticulously packaged and shipped to meet our rigorous standards. In the rare and unlikely event that an item sustains damage during transit, rest assured that the item is fully covered. However, it is the customer’s responsibility to thoroughly inspect the item upon delivery to confirm that its condition matches the detailed photos and notes provided before purchase and after packaging for shipment. 
 
To maintain transparency, we provide customers with comprehensive documentation of their product’s condition, including written notes and detailed photos, before and after packaging. This ensures that customers can make their purchase with complete confidence. 
 
If an item does arrive with damage incurred during transit, customers must document the issue in writing and with detailed photos. This documentation must be provided to both the carrier and Mardey’s immediately upon delivery. Prompt reporting is critical, as delays may result in the carrier denying a reimbursement. 
 
Although instances of transit damage are exceedingly rare, Mardey’s is here to fully support our customers. We will collaborate with the carrier to ensure that any damage claims are resolved, and your item is either repaired, replaced, or refunded as appropriate.
 
Once an order has shipped, it is of the utmost importance that the customer accepts and coordinates delivery with the carrier upon receiving notification. All carriers operate differently, and customers must adhere to the carrier’s procedures for scheduling and accepting delivery.
 
Customer Responsibility For Coordinating Delivery
 
In the event that a carrier is unable to make contact with the customer, the carrier may store the item at their local distribution hub for a limited number of days, which may incur additional fees at the customer’s expense. If the customer fails to coordinate delivery within the carrier’s specified timeframe, the order may be returned to the vendor.
When an item is returned to Mardey’s due to a failure to acknowledge or schedule delivery, the carrier will charge a return fee to ship the item back to the vendor. Additionally, the order will be subject to a restocking fee of up to 35%. In such cases, the customer will be refunded the total of their original purchase price less:
 
  • The original shipping cost to the customer,
  • The return shipping cost to the vendor, and
  • Any applicable restocking fee (up to 35%).
 
To avoid these additional costs, we strongly urge customers to respond promptly to carrier notifications and ensure delivery is coordinated in a timely manner.
