Purchase Agreement
At Mardey’s, we take pride in offering high-quality appliances and products at unbeatable prices. As a unique retailer, unlike large chain stores, we specialize in providing aggressive pricing at wholesale price points, ensuring the best savings opportunities for our customers. As further described below, certain qualifying major appliances may include a complimentary one-year limited warranty through third-party warranty providers, subject to the terms and conditions described herein.
If you have any issues within seven (7) days from placing your order, you must contact us directly for resolution in accordance with our Return Policy set forth below.
By completing your purchase as a customer of Mardey’s, you confirm that prior to completing your purchase you had the opportunity to read these Terms & Conditions, and that you acknowledge, understand, and agree to all of the following terms and conditions.
WARRANTIES
Certain product categories—including but not limited to lighting, electronics, audio equipment, home décor, furniture, hardware, tools, fitness products, home accessories, kitchen and bath accessories, outdoor products, small appliances, and similar non-appliance categories—do not include the complimentary one-year limited warranty offered on qualifying major appliances. These items are sold “AS-IS”, WITHOUT WARRANTY OF ANY KIND, except where required by law. Any manufacturer warranties, if applicable, must be handled directly with the manufacturer.
Mardey’s provides a complimentary one-year parts and labor warranty only for qualifying major appliances, via third-party warranty providers. The choice of warranty provider is determined solely by Mardey’s based on customer location and cannot be chosen by the customer. Warranty coverage begins upon delivery. Any warranty claims submitted after the first thirty (30) days from delivery must be submitted directly to the assigned third-party warranty provider.
EXCEPT AS OTHERWISE PROVIDED HEREIN WITH RESPECT TO THE COMPLIMENTARY ONE-YEAR LIMITED WARRANTY ON QUALIFYING MAJOR APPLIANCES, OUR RETURN POLICY, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
OUR PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND YOU EXPRESSLY AGREE THAT PURCHASE OF ANY PRODUCTS FROM US IS AT YOUR SOLE RISK. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT OUR PRODUCTS WILL MEET YOUR REQUIREMENTS, OR THAT ANY PRODUCTS OFFERED BY US WILL BE ERROR-FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US, OR THROUGH ANY SERVICE OR PRODUCTS OFFERED BY US, SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
WE ATTEMPT TO BE AS ACCURATE AS POSSIBLE IN OUR PRODUCT INFORMATION AND DESCRIPTIONS. WE DO NOT WARRANT THAT PRODUCT DESCRIPTIONS, SPECIFICATIONS, OR OTHER CONTENT ON OUR WEBSITE ARE ERROR-FREE, ACCURATE, COMPLETE, RELIABLE, OR CURRENT.
LIMITATION OF LIABILITY (GLOBAL)
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EITHER PARTY’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THIS AGREEMENT EXCEED THE AMOUNT ACTUALLY PAID BY CUSTOMER TO MARDEY’S DISCOUNT APPLIANCE & REPAIR LLC OR MARDEY’S LLC FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
IN NO EVENT SHALL EITHER PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF BUSINESS, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
UNDER NO CIRCUMSTANCES, INCLUDING, WITHOUT LIMITATION, NEGLIGENCE, SHALL MARDEY’S OR OUR PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY DAMAGES RESULTING FROM THE USE OR INABILITY TO USE ANY PRODUCTS OFFERED BY US, OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED. IF YOU ARE DISSATISFIED WITH ANY PRODUCT OR SERVICE OFFERED BY US, YOUR EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE PRODUCT OR SERVICE, WITH ANY REFUND BEING ALLOWED SOLELY PURSUANT TO OUR RETURN POLICY SET FORTH BELOW.
1. SALE DISCLAIMER
All sales of open-box appliances are subject to our 7-Day Return Policy, after which they are deemed final.
Mardey’s guarantees functionality of all products as set forth herein; however, cosmetic imperfections are understood to be fully accepted on an “AS-IS” basis, subject to our 7-Day Return Policy. “Cosmetic Imperfections” are defined as any irregularity that does not affect the intended function or performance of a product, but may affect its appearance, including, without limitation, scratches, discoloration, damage, chips, scuffs, finish imperfections, blemishes, dings, dents, or other cosmetic issues.
These Cosmetic Imperfections are not grounds for refunds, cancellations, or exchanges of any kind beyond what is expressly permitted under our 7-Day Return Policy. By completing your purchase, you acknowledge and accept that these cosmetic imperfections do not affect the appliance’s functionality, and any concerns regarding appearance will only be eligible for a return pursuant to our Return Policy.
Qualifying major appliances are covered by a limited parts and labor warranty for twelve (12) months from the date of purchase, subject to the terms and conditions of the applicable third-party warranty provider. Any claims made after such twelve (12) month period are not covered by Mardey’s. We remain committed to addressing functional issues within that warranty period in accordance with these Terms.
2. CONDITION OF PRODUCTS
Our inventory includes both items in excellent condition and items with Cosmetic Imperfections:
- Whether the product is open-box or factory-sealed, all products are sold solely on an AS-IS basis, subject to our 7-Day Return Policy. Cosmetic Imperfections are not grounds for compensation, refunds, or adjustments.
- We make every effort to describe each product’s condition in detail; however, the risk associated with purchasing an item in its current condition is solely the customer’s responsibility.
- Appliances are graded based on Cosmetic Imperfections that are visible only when installed. Cosmetic Imperfections not visible once installed are not considered flaws or defects.
- All units, regardless of grade or Cosmetic Imperfections, are guaranteed to function as intended, subject to our warranty terms for qualifying major appliances.
- Any issues that arise after the 7-day return window will be handled exclusively by the applicable third-party warranty company, where coverage applies.
3. IMPORTANT CONSIDERATIONS
Our team works diligently to identify all visible front-facing Cosmetic Imperfections on each product. However, some Cosmetic Imperfections may be unintentionally missed during the grading process. This inherent risk is a key factor that allows us to offer the best prices and service to our customers.
We strongly encourage you to review all product photos, videos, and descriptions carefully before purchasing to ensure you select the appliance grade and condition that best fits your needs.
4. PRICE ADVANTAGE
Unlike big-box retailers, we offer aggressive pricing at wholesale price points, passing on the best savings opportunities directly to our customers. Because we sell open-box items, we can offer significant discounts compared to new, factory-sealed products.
Both open-box and factory-sealed products may have been returned, opened for display, or handled in a manner that results in minor Cosmetic Imperfections. The discounted prices reflect the condition of the products, including any such Cosmetic Imperfections.
5. OPEN-BOX AND FACTORY-SEALED PRODUCTS
Even products still in their original packaging (factory-sealed) may be considered “open-box” if they have been returned or displayed. A small percentage of factory-sealed products may have minor Cosmetic Imperfections due to handling or external factors. While these products are typically in new, unused condition, imperfections may occur as a result of handling, transit, or storage.
Both open-box and factory-sealed products fall under the same policy and may show signs of handling, but are sold at a significant discount to reflect their condition.
6. SHIPPING & TRANSIT DAMAGE POLICY
We take great care to professionally package all appliances using appropriate protective materials to help ensure safe delivery. However, damage can occasionally occur during transit. It is the customer’s responsibility to inspect the packaging for visible damage at the time of delivery, before signing or accepting the shipment.
If obvious damage to the packaging is observed—such as punctures, crushing, tearing, or other signs of mishandling—this may indicate possible transit damage. These issues pertain solely to shipping-related damage and do not include Cosmetic Imperfections disclosed and accepted at the time of purchase.
Important: If you intend to refuse delivery due to packaging damage, do not open or unpackage the item. If the item is unpackaged and then refused, the customer will be fully responsible for securely repackaging the unit to ensure its safe return.
If packaging damage is visible at delivery, you must:
- Refuse the delivery and do not sign for the item.
- Clearly note the visible packaging damage with the delivery driver.
- Take detailed photographs of the damaged packaging.
- Email all documentation (photos and a brief description) to the designated Mardey’s email address within twenty-four (24) hours.
Once an item is accepted or signed for, it is deemed delivered in acceptable condition. At that point, the customer assumes full responsibility for any transit-related damage and must file a claim directly with the freight carrier within twenty-four (24) hours of delivery. Copies of all supporting documentation must also be sent to Mardey’s at the designated email address. Failure to complete these steps will constitute acceptance of the product in its delivered condition and a waiver of any claims related to shipping damage.
Once the item has been refused and Mardey’s has been notified, the unit will be returned to the vendor for inspection and processing. After inspection, a full refund will be issued to the customer’s original payment method. While timing may vary depending on carrier logistics, refunds are typically processed within twenty-four (24) hours of inspection completion.
A. Freight / LTL Shipping
Freight / LTL shipping is used for large appliances, oversized items, and certain furniture. The responsibilities described above regarding inspection, refusal, documentation, and claims apply fully to all freight / LTL shipments.
B. Standard Ground Shipping
Standard ground shipping is used for smaller items, such as accessories, lighting, electronics, décor, hardware, and small appliances. Ground shipments typically cannot be refused solely for packaging damage; however, the customer must inspect the shipment within forty-eight (48) hours of delivery. Any damage or missing items on standard ground shipments must be reported to Mardey’s within forty-eight (48) hours of delivery with supporting photos. Late reports may not be eligible for support or remedies.
C. Mixed Orders
Orders may include both freight and ground shipments. Customer responsibilities apply per item based on the applicable shipping method.
WARRANTY AND SERVICE
Qualifying open-box and other eligible major appliances come with a standard one-year parts and labor warranty, provided through Mardey’s partnered third-party warranty providers. The choice of warranty provider is determined solely by Mardey’s based on location and cannot be selected by the customer. Customer purchases are registered for warranty at the time of purchase, and warranty periods begin upon delivery.
WARRANTY & SERIAL NUMBER DISCLAIMER
Some appliances may arrive with the original model and/or serial numbers removed by the manufacturer, indicating that the manufacturer no longer provides warranty coverage on that specific unit. In these cases, the appliance has been fully tested, inspected, and verified by our team. We then assign an internal serial number for tracking and warranty purposes.
These appliances qualify for a full one (1) year parts and labor warranty through our third-party warranty provider, with the option to purchase additional extended warranties at the time of checkout.
Open-box appliances may not include original accessories, manuals, trims, or other components; customers should verify included items prior to purchase. This is a minimal trade-off when purchasing an open-box appliance—while you are able to take advantage of significant price discounts and savings, some items that are typically included with brand-new, in-box units may not be present.
Mardey’s is not responsible for managing, coordinating, or explaining the policies of any third-party warranty provider, and strongly advises customers to familiarize themselves with the applicable warranty terms.
Any warranty-related issues reported within the first thirty (30) days of delivery must be submitted directly to Mardey’s. After this thirty (30) day period, customers must contact the assigned third-party warranty company directly for assistance.
It is essential that customers accurately report the timing and nature of any issues that arise after delivery. Claims that suggest a defect or condition was “always present” without having been reported previously may be denied due to lack of supporting evidence that the issue existed at the time of delivery. Do not misrepresent the condition of the product. If the appliance functioned properly and later developed an issue, you must clearly state when the problem began in order to file a valid claim. Failing to do so may result in rejection of the claim for lack of proper documentation or misrepresentation of the issue timeline.
Any functional issues must be reported pursuant to our Return Policy. Reports made after the 7-day return period will fall under the “AS-IS” policy and will not be eligible for refunds or exchanges except as required by law. Any issues outside of the 7-day return window will be handled solely by the applicable warranty provider, where coverage applies.
CUSTOMER ACKNOWLEDGMENT
By making a purchase, you hereby acknowledge and agree that:
- You have reviewed and understand the information available through Mardey’s that educates customers on product information, including, without limitation, grade, condition, affected areas, grading scales, and warranty coverage.
- You fully understand the condition of the open-box appliance and completely accept any and all risks associated with any Cosmetic Imperfections that may not be visible at the time of purchase.
- You have read and understood our product descriptions, including any disclaimers about Cosmetic Imperfections, and have reviewed all relevant photos.
- All sales at Mardey’s are sold “AS-IS,” subject to our Return Policy, which means you accept the product in its current condition except as expressly provided herein.
- BY COMPLETING YOUR PURCHASE, YOU AGREE TO FIRST CONTACT MARDEY’S TO ATTEMPT TO RESOLVE ANY ISSUES BEFORE INITIATING ANY CREDIT CARD DISPUTES OR CHARGEBACKS. YOU ACKNOWLEDGE THAT INITIATING A CHARGEBACK WITHOUT FIRST ATTEMPTING TO RESOLVE THE ISSUE WITH MARDEY’S CONSTITUTES A MATERIAL BREACH OF THESE TERMS & CONDITIONS AND MAY RESULT IN IMMEDIATE LEGAL ACTION. YOU FURTHER AGREE THAT CHARGEBACKS WILL ONLY BE INITIATED IN CASES OF PROVEN FRAUDULENT TRANSACTIONS WITH THE CONSENT AND COOPERATION OF MARDEY’S.
- Mardey’s solely guarantees functionality of all products as provided for herein, but Cosmetic Imperfections are understood to be AS-IS, and any products will only be eligible for a return pursuant to our Return Policy.
- Mardey’s policy on returning any products sold hereunder is as follows (our “Return Policy”).
7. 7-DAY RETURN POLICY
- Returns must be initiated within seven (7) calendar days of the delivery date to be eligible for a refund, subject to the terms outlined below.
- To initiate a return, the customer must contact Mardey’s by email within the 7-day return window and include:
- Detailed photographs of the product and packaging; and
- A written statement explaining the item’s condition and the reason for the return pursuant to this Return Policy.
- Returns will not be accepted without a valid Return Authorization (RA) number, which is issued by Mardey’s after receipt and review of the required documentation. Any item returned without an RA will be rejected.
- Customers are solely responsible for coordinating and covering all shipping, packaging, handling, and insurance associated with the return. Mardey’s does not issue prepaid return labels or schedule freight pickups for any return shipments.
- Returned products must be packaged in the same condition and manner as originally shipped to ensure safe and secure transit.
- Returned items must be unused, undamaged, and unaltered, and must include all original packaging, accessories, manuals, literature, and blank warranty cards. Items returned in any other condition may be denied or subject to deductions.
- Refunds will be issued only after full inspection and verification of the returned product by Mardey’s, at our sole and absolute discretion.
- All approved returns are subject to an eighteen percent (18%) restocking fee.
- If an item arrives with visible shipping damage, it must be refused at the time of delivery. Accepting a visibly damaged shipment waives your right to a refund or return based on transit damage, in accordance with Mardey’s Shipping & Transit Damage Policy. If the customer accepts the item and later reports transit damage, the return will not be eligible for refund.
- If a product is damaged during return transit, it will be the customer’s responsibility to file a claim with the carrier. Mardey’s cannot issue a refund for any item returned in a condition different from when it was originally sold or delivered.
- Upon expiration of the 7-day return window, all sales are final and non-refundable.
7.2 ORDER CANCELLATION POLICY
- All order cancellations, regardless of whether the item has shipped or not, are subject to a twelve percent (12%) cancellation fee. This fee covers administrative, processing, and allocation costs incurred at the time of order placement.
- No exceptions: The cancellation fee applies to all orders and cannot be waived under any circumstance.
- Applies to all orders: Whether the product has shipped, is pending shipment, or is on backorder, the twelve percent (12%) cancellation fee remains in effect.
8. ADDITIONAL LIMITATION OF LIABILITY – PRODUCT USE AND DAMAGES
Subject to the global Limitation of Liability provisions set forth above and to the fullest extent permitted by law, Mardey’s will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use any product.
Customers acknowledge that Mardey’s is not responsible for any damage, loss, or injury, including property damage or personal injury, resulting from the installation, use, misuse, or operation of the appliance.
9. DISPUTE RESOLUTION AND EXCLUSIVE JURISDICTION
Any dispute, claim, or controversy arising out of or relating to this Agreement, these Terms & Conditions, or any products or services purchased from Mardey’s (collectively, “Disputes”) shall be resolved as follows:
a. Mediation
The parties agree that any Dispute shall first be submitted to non-binding mediation administered by the American Arbitration Association (“AAA”) under its applicable mediation rules.
b. Arbitration
If the Dispute is not resolved within thirty (30) days after commencement of mediation, the Dispute shall be settled by binding arbitration administered by the AAA in accordance with its Consumer Arbitration Rules and the Florida Arbitration Code (Chapter 682, Florida Statutes). The arbitration shall take place in Broward County, Florida. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.
Each party shall bear its own costs and expenses, and the parties shall share equally the mediator’s and arbitrator’s fees unless otherwise determined by the arbitrator.
c. Exclusive Jurisdiction for Enforcement and Injunctive Relief
For purposes of enforcing any arbitration award or seeking injunctive relief or any other form of relief not available in arbitration, the parties irrevocably consent to the exclusive jurisdiction of:
- The state courts located in Broward County, Florida; or
- The United States District Court for the Southern District of Florida.
Each party waives any objection to venue or forum non conveniens for such actions.
10. CLASS ACTION WAIVER
The parties agree that any Dispute, claim, or controversy arising out of or relating to this Agreement or any products or services provided by Mardey’s shall be resolved on an individual basis only. NEITHER PARTY SHALL HAVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER REPRESENTATIVE PROCEEDING AGAINST THE OTHER PARTY, WHETHER IN ARBITRATION OR IN COURT.
The parties expressly waive any right to bring or participate in any class, collective, or representative action in any forum.
11. GOVERNING LAW
This Agreement and these Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles.
12. TERMS MODIFICATION
Mardey’s reserves the right to modify these Terms & Conditions at any time without prior notice to the customer. Any such modifications will apply to all purchases made after the effective date of the revised Terms & Conditions.
13. CREDITORS NOT BENEFITED
Nothing in these Terms & Conditions is intended to benefit any creditor of the customer. No creditor of the customer will be entitled to require Mardey’s to enforce any right that the creditor may have against the customer.
14. SEVERABILITY
If any portion of these Terms & Conditions is held illegal, invalid, or unenforceable, the customer and Mardey’s agree that such portion shall be severed from the remainder of the Terms & Conditions, and the remaining provisions shall remain in full force and effect and constitute the agreement between the customer and Mardey’s with respect to the subject matter hereof.
15. ENTIRE AGREEMENT
These Terms & Conditions:
- constitute the entire agreement between you and Mardey’s with respect to the subject matter hereof;
- supersede any prior or contemporaneous agreements, whether oral or written, between you and Mardey’s relating to the purchase of products and services; and
- shall control and govern all transactions between you and Mardey’s with respect to the sales and purchases of products and services from Mardey’s.
16. WAIVER
No failure or delay by Mardey’s in exercising any of its rights under these Terms & Conditions shall be deemed to be a waiver of that right, and no waiver by either you or Mardey’s of a breach of any provision of these Terms & Conditions shall be deemed to be a waiver of any subsequent breach of the same or any other provision herein.
17. CUSTOMER RESPONSIBILITY UPON DELIVERY
Shipping Damage Inspection & Return Procedure
Mardey’s takes pride in the care and precision used to professionally package each appliance for safe transit. Despite our high standards, shipping-related damage can occasionally occur. As the recipient, you are responsible for inspecting the packaging (not the product) at the time of delivery—before signing or accepting the shipment.
If the packaging shows any signs of damage such as tearing, punctures, crushing, or other mishandling, this may be evidence of transit-related damage. This does not include Cosmetic Imperfections disclosed at the time of purchase, which are not considered shipping damage and are not eligible for return on that basis.
Important: If you plan to refuse delivery due to packaging damage, do not open or unbox the appliance. If you do open it and still choose to refuse delivery, you will be responsible for repackaging the unit securely for return.
If packaging damage is observed at the time of delivery:
- Refuse the shipment and do not sign for the item.
- Ensure the driver notes the damage on the delivery receipt.
- Take detailed photos of the visible damage.
- Email all documentation and a brief summary to the designated Mardey’s email address within twenty-four (24) hours.
If you accept or sign for the item, it is considered delivered in satisfactory condition. From that point forward, the customer assumes full responsibility for any shipping-related damage. If damage is later discovered, you must file a claim directly with the freight carrier within twenty-four (24) hours of delivery and send all documentation to Mardey’s. Failure to follow this process will result in the waiver of any rights to file a shipping damage claim.
If the delivery is properly refused and Mardey’s is notified, the item will be returned to our vendor for inspection and processing. After inspection, a full refund will be issued to the original payment method. While timing may vary depending on carrier logistics, refunds are typically processed within twenty-four (24) hours of inspection completion.
18. CUSTOMER RESPONSIBILITY FOR COORDINATING DELIVERY
In the event that a carrier is unable to make contact with the customer, the carrier may store the item at its local distribution hub for a limited number of days, which may incur additional fees at the customer’s sole expense without any right of reimbursement.
If the customer fails to properly coordinate delivery within the carrier’s specified timeframe and procedures, the order will likely be returned to the vendor. When an item is returned to Mardey’s due to a failure to acknowledge or schedule delivery, the carrier will charge a return fee to ship the item back to the vendor, which will be the responsibility of the customer.
Additionally, the order will be subject to a restocking fee of eighteen percent (18%). In such cases, the customer will be refunded the total of their original purchase price plus any paid sales taxes, less:
- the original shipping cost to the customer,
- the return shipping cost to the vendor, and
- the applicable restocking fee of eighteen percent (18%).
To avoid these additional costs, customers agree to respond promptly to carrier notifications and ensure delivery is coordinated in a timely manner.
19. NOTICES
Any notice provided or permitted to be given under these Terms & Conditions shall be in writing and may be served by personal delivery, by registered or certified U.S. mail (postage prepaid, return receipt requested), or by a nationally recognized delivery service, addressed to the party to be notified at its designated address.
Notice deposited in the mail in the manner described above shall be deemed to have been given and received on the date of delivery as shown on the return receipt. Notice served in any other manner shall be deemed to have been given and received only if and when actually received by the addressee.
Notices sent by email transmission will not be effective for any purpose under these Terms & Conditions with respect to any notice regarding arbitration. While the parties may choose to use email transmissions for convenience in the normal course of business, all notices of a nature regarding arbitration must be given in accordance with the “in writing” requirements described above.
